Administrative rulemaking is subject to different rules depending on the authority in charge. When the government is responsible, the constitutional rules regarding the consultation of stakeholders, as laid down in the Instrument of Government, apply. Moreover, the Constitution establishes a general obligation of objectivity that applies to all public authorities and affects the adoption of administrative rules. Rulemaking performed by administrative authorities under the government must follow the ordinance (2024:183) on Impact Assessments, which requires public authorities to investigate the costs and other impacts of proposed rules. Finally, rulemaking performed by municipal authorities must follow the consultation mechanisms contained in the Local Government Act (2017:725), which mandates consultation with those who use their services.
