With the increase in unaccompanied children in 2015, it has become common to discuss the legal status of unaccompanied children. By the Swedish law persons under the age of 18 are considered to be minors and therefore have no ability to make decisions in personal matters with legally binding effects. A childs case does not always require the same seriousness as adult cases to be able to obtain a residence permit. This leads to at different asylum process for unaccompanied children who lack guardians upon arriving to Sweden. Various assessments are made for unaccompanied children that adults do not need to undergo for a residence permit. Through the legal dogmatic method, an analysis and report has been made in relation to the EU law, current Swedish laws and international commitments that affect unaccompanied childrens rights within Swedish legislation. The courts way of assessing grounds for protection, as well as how these are tried has been analyzed. The concept of unaccompanied children has been defined, but the focus on their rights in Sweden has also been reported.
Legislation on benefit sharing dates back to 1992 and the commandment of the UNConvention on Biological Diversity, hence implementation still has few cases to fall back on(CBD, 1992). The case study of the project ProBenefit presented by the thesis highlights howlack of deliberation can undermine a democratic process. The objective of the thesis is thatProBenefit’s attempt to implement the standards of the CBD on access and benefit sharingwill highlight not only problems met by this specific project, but difficulties that generallymeet democratic processes in contexts of high inequality. To define if the project ProBenefitsucceeded in carrying out a deliberative process the project will be analyzed by the criteria:access to information, representation, legitimacy and involvement.The population in the project area of ProBenefit had a long history of social marginalization,which made it hard for foreign projects to gain legitimacy. The lack of independentorganizations and the late establishment of the project, which resulted in time shortage, madeit impossible to prevent the distrust of the local population. The failure of the projectcoordinators to ensure active participation of all stakeholders resulted in a late and lowinvolvement of the local participants. The absence of independent organization also madedemocratic legitimacy of the process questionable. Even if ProBenefit had a vision ofdemocratic deliberation the project was unable to break down the prevailing unequal powerdistribution which resulted in an unsustainable process and failure. The conclusion of thethesis is that the attainment of deliberation foremost depends on how a project deals with theexisting distribution of power and how it succeeds in involving all stakeholders.
De rättsstatliga värdena betraktas numera som centrala i en modern demokratisk stat. De brukar sammanfattas med krav på normbunden, opartisk och saklig maktutövning med respekt för allas likhet inför lagen. I den moderna tolkningen ryms även ett krav på ett demokratiskt styrelseskick.
Förvaltningens roll att upprätthålla och värna rättsstaten får vanligtvis inte särskilt mycket uppmärksamhet i olika förvaltningspolitiska studier. Vi har därför låtit ett urval av rättsstatligt intresserade forskare analysera och diskutera utvecklingstendenser och förändringsbehov i den statliga förvaltningen och i förvaltningspolitiken ur ett rättsligt perspektiv.
I antologin lyfter tio forskare bland annat fram de rättsstatliga utmaningar som hänger samman med förhållandet mellan regeringen och myndigheterna. Frågorna som behandlas är relevanta för såväl regeringen som förvaltningen och tjänstemannagruppen i stort. De olika kapitlen handlar främst om den politik och styrning som riksdagen och regeringen riktar mot den statliga förvaltningen. Men eftersom många viktiga statliga åtaganden genomförs inom hela den offentliga förvaltningen berör texterna även kommunala och regionala verksamheter.
My essay is on the subject of teachers work environment with focus on noise and communication. In the essay questions are raised on how a teacher can influence his or hers noisy work environment. A school is a large work place with many employees and is owned and administered by the county municipality which is an even bigger workplace. How big an acting space does a teacher have in such a large organization?
My methods of research on these questions have been to conduct interviews and analyzing documentation from The Swedish Work Environment Authority. The Swedish Work Environment Authority inspects workplaces and conducts work environment inquiries by inspecting and discovering misdoings/abuses. They put high demands on workplaces by imposing a high fine. I have investigated a preschool and an upper secondary school that have had problems with their noise environment.
The result of the research is that a teacher, to a certain extent, can influence his or hers work environment, but that the teacher needs support from The Work Environment Authority in order to achieve real change. When the employee has risen the issue of a noisy work environment there has been no immediate response from the board of directors in the municipality. In the upper secondary school there were no major changes despite The Work Environment Authority imposing a large fine.
