    By employing a mix between qualitative and quantitative methods, we explored the ways in which file sharers themselves conceive of the future of “piracy.” A content analysis of a selection of open answers from the Research Bay study (a global file sharing survey conducted in collaboration with file-sharing site The Pirate Bay in April, 2011, with more than 75,000 respondents) revealed significant differences between active uploaders and the much larger group of respondents who regularly download files but never upload. Tropes of “community” were not particularly abundant in this corpus. The biggest singular tropes were those of unstoppability/technical resilience (“File-sharing won’t be stopped”); convenience/availability/supply; skepticism/hostility towards governmental intrusion; and—surprisingly—the trope that file sharing will eventually be integrated with the market. This latter trope was particularly common among the non-uploaders (representing the majority of Pirate Bay users) compared to the dedicated uploaders. The non-uploaders also appeared to be more disposed towards a generic belief in the progress, evolution, and a potential convergence/assimilation of technology.

    Abstract [en]

    Judicial preview acts as a tool to assure that no laws to be enacted conflicts with the constitution. For that reason, it is of importance that the authorities set to perform the judicial preview are independent towards the ruling power. The aim of this essay is to do a comparison between how judicial preview is done by the Council on Legislation in Sweden and by the Constitutional Council in France. The essay examines how this preview acts as a tool to guarantee the supremacy of the constitution and to insure a none confrontational legal system. This is done with the help of the method of comparative law and the legal dogmatic method. The result of the analysis shows that judicial preview plays an increasingly important role of guaranteeing the supremacy of constitutions in legal systems of increased complexity and in societies that are experiencing political tensions. The result also shows that the constitutions in both Sweden and France is increasing in importance to protect the ways of government, democracy and basic rights for the citizens. Based on the analysis the forms of judicial preview should be reviewed and stronger safeguards for the constitution may be of interest in the future.

    Abstract [en]

    The principle of proportionality is considered one of the most important contemporary legal principles on which it intends to protect individual citizens against disproportionate action by the authorities. This aroused our interest prior to this study. The essay reveals how such behavior might look like and how courts have chosen to adjudicate in cases where the individual has been discriminated against or subjected to unreasonable demands in public procurement. That section of the law that were current throughout all court cases are Public Procurement Act (2007:1097) LOU. That which we have seen in every court case is that the applicant has not received a proper fair chance when the requirements of the contract often been asked in a way that either exclude the smaller applicant company or rule out various potential applicants parties due to excessive and sometimes unnecessary requirements. The consistently demonstrated in the study of court cases is that the authorities in all ten cases have had problems with necessity assessment of the claims shall be made, however, no authority in these cases had any confusions about whether it was appropriate for attaining the objective pursued. Another important discovery along the way has been assessed according to the constituent elements of the Public Procurement Act has been interpreted somewhat differently by different courts. Which may give a distorted picture of the courts positions in just the proportionality assessment. It could even be seen as a lack of legal certainty, the principle of proportionality is not firmly established through the codification of the current Administration Act but instead occurs scattered over different regions of justice. Study also showed that courts only rely on European law in a few cases despite principle of proportionality strong roots in Europe.

    This book offers a unique overview of the main legal systems of administrative sanctions with thorough analyses of the administrative law sanctioning systems in 13 Member States and the European Union. The focus is on both remedial and  deterrent sanctions in administrative law. Especially where deterrent sanctions are involved, the aspects of national and international constitutional law are analysed as well as the influences of criminal law approaches in this legal area. After a general analysis of the definitions of sanction, thorough country analyses are presented of Austria, Belgium, Finland, France, Germany, Greece, Italy, the Netherlands, Portugal, Romania, Spain, Sweden and United Kingdom.     Abstract [en]

    An effective, inclusive democracy requires maximal transparency of ‘public information’ while, on the contrary, limiting transparency of ‘personal information’ to the minimum. However, these two transparencies have an intricate relationship: they may be independent of each other, complementary to each other, or antinomical. Additionally, the development of an information society that leads to the fusion of the  private and public spheres, the cross-utilization by the public and private sectors of their respective data, and to an increase in the dangers common to both sectors, further complicates the picture. In weakening individuals as human beings and citizens, the digital era generates threats for democracy and the Rule of Law. There is, therefore, a need for an adequate protective framework and for the main legal protagonists to face the new informational and societal challenges. The obligation to preserve underlying, foundational democratic values lies also with the business sector and with citizens themselves.

    Abstract [en]

    A concrete result of the 2011 United Nations Climate Change Conference in Durban (COP17) was the establishment of the Green Climate Fund (GCF), with the aim of channelling $100 billion per year from developed countries to developing countries to support their efforts to respond to climate change and promote sustainable development. The emerging global architecture for climate finance raises significant questions related to public policy and environmental governance. Participatory governance practices, including freedom of information, are increasingly considered effective tools for both coping with environmental problems and finding sustainable solutions to development challenges. Moreover, without sufficient transparency in their decision making, the various climate funds are unlikely to attract a sufficient supply of urgently needed finance, and the ambitious targets of the GCF will be unmet. Yet, the question of the modality and process for governing climate finance is undetermined and obscure. The complexity of climate finance stems from a multi-level structure with international, regional, national, and sub-national actors; multi-sector dimensions, with both public and private donors and recipients; and the sector’s global/multilateral/multidirectional character. This article amplifies the “transparency pressure points” in climate finance generally and the GCF specifically. Public policymaking, in response to the many complex and urgent climate change challenges, may depend on securing the principle of freedom of information within the global climate finance architecture.

    Ekonomer betraktar vanligtvis konkursutvecklingen som en konjunkturindikator och därmed beroende av förändringar på ekonomins efterfrågesida: konkurserna förväntas öka i tider av ekonomisk nedgång och minska under högkonjunkturer. Flertalet analyser är emellertid kortsiktiga. I denna uppsats presenterar vi ny och unik empiri där vi ana­lyserar det långsiktiga sambandet mellan konjunkturväxlingar och konkurser i Sverige mellan år 1830 och år 2010. I uppsatsen diskuteras också problem som kan uppstå i tolk­ningen av konkursstatistiken, både historiskt och i vår samtid. Den statistiska analysen visar att det delvis går att fastställa ett samband mellan makroekonomiska svängningar och förändringar i konkursmängden.

    Abstract [en]

    Legislation on benefit sharing dates back to 1992 and the commandment of the UNConvention on Biological Diversity, hence implementation still has few cases to fall back on(CBD, 1992). The case study of the project ProBenefit presented by the thesis highlights howlack of deliberation can undermine a democratic process. The objective of the thesis is thatProBenefit’s attempt to implement the standards of the CBD on access and benefit sharingwill highlight not only problems met by this specific project, but difficulties that generallymeet democratic processes in contexts of high inequality. To define if the project ProBenefitsucceeded in carrying out a deliberative process the project will be analyzed by the criteria:access to information, representation, legitimacy and involvement.The population in the project area of ProBenefit had a long history of social marginalization,which made it hard for foreign projects to gain legitimacy. The lack of independentorganizations and the late establishment of the project, which resulted in time shortage, madeit impossible to prevent the distrust of the local population. The failure of the projectcoordinators to ensure active participation of all stakeholders resulted in a late and lowinvolvement of the local participants. The absence of independent organization also madedemocratic legitimacy of the process questionable. Even if ProBenefit had a vision ofdemocratic deliberation the project was unable to break down the prevailing unequal powerdistribution which resulted in an unsustainable process and failure. The conclusion of thethesis is that the attainment of deliberation foremost depends on how a project deals with theexisting distribution of power and how it succeeds in involving all stakeholders.

    Abstract [en]

    Following an increase in Roma migration under the European “freedom of movement” laws, Swedish municipalities initiated more than 80 evictions of informal Roma settlements on the grounds of poor sanitation between 2013 and 2016. These evictions echo policies from earlier in the 20th century, when Roma living in Sweden were often marginalized through the denial of access to water and sanitation facilities. The recent Swedish evictions also follow similar government actions across Europe, where Roma settlements are controlled through the denial of access to water and sanitation. However, access to water and sanitation—central aspects of human health—are universal human rights that must be available to all people present in a jurisdiction, regardless of their legal status. The evictions described here violated Sweden’s obligations under both European and international human rights law. More positive government responses are required, such as providing shelters or camping sites, setting up temporary facilities, and directly engaging with communities to address water and sanitation issues. The authors conclude by providing guidance on how states and municipalities can meet their human rights obligations with respect to water and sanitation for vulnerable Roma individuals and informal settlements in their communities. © 2017 Davis and Ryan.

    The EU Services Directive (SD) is a centrepiece for the realisation of the Internal Market in the services sector aiming at considerably lowering the barriers for service provision in the EU. This chapter therefore analyses the transposition and implementation of the requirements of the SD into the national (administrative) law system of France. This chapter treats all relevant requirements of the SD, such as the Point of Single Contact (POSC), the screening of national law according to the requirements of the SD, the adaption of authorisation schemes for service provision, the requirement of ‘tacit authorisation’ and the need for new rules on administrative cooperation.     Abstract [en]

    This master's thesis on the subject of public law will deal with the implications ”Directive 2001/18/EC on the deliberate release into the environment of genetically modified organisms” might have on the Swedish legal system. The purpose of the directive is to harmonize the European Union States legislation regarding licensing of the deliberate release of GMO’s into the environ­ment, this to maintain a high level of environmental protection and at the same time preserve the internal market of the European Union. The thesis will primarily examine how the provisions of the directive relating to the general principle of good administration have impacted the proce­dural autonomy of Sweden. It will also explore whether the provisions of the directive have im­pact­ed Sweden’s institutional autonomy. This study is to be regarded as the thesis’ main pur­pose. The master’s thesis will also briefly touch upon the general principle of good admini­stration, proce­dural and institutional autonomy and the European Union law’s judicial relation to the member states. A summary of the legislation process preceding the directive on the deliberate release into the environment of GMO’s can also be found, it focuses on the discussions in the different Institutions of the Euro­pean Union regarding the general principle of good admini­­stra­tion. A similar summary of the Swedish implementation process of the directive is also included.

    The thesis shows that several provisions in the directive regarding the general principle of good administration have in fact impacted the Swedish procedural autonomy. It also shows that Swedish legislators has been forced to introduce new procedural rules into Swedish law in order to meet the demands of the directive on the deliberate release into the environment of GMO’s while implementing the directive.  However, no major impact on the Swedish institutional autonomy has been noted.  At the end of the thesis the results and whether or not there is a need for a codified and uniform European administrative law is discussed.

    Det finns ett ökat hot för kränkning av den enskildes personliga integritet i dagens informationssamhälle. Både enskilda och stater kan missbruka informationen om den enskildes privata förhållanden i egna syften. Samtidigt har en myndighet behov av informationen som underlag för att utföra välfärdstjänster och ta myndighetsbeslut. För att inte känslig information ska hamna i orätta händer finns lagen som ett skydd för den enskildes personliga integritet. Uppsatsen jämför Finlands och Sveriges rättsordningar utifrån materiell och formell rättsäkerhet gällande skyddet för den personliga integriteten vid myndigheters informationsutbyte.

    Genom att kompararera två rättsordningar får analysen ytterligare en dimension – vilket system ger störst effekt och hur kan det andra systemet inspireras? Slutsatsen är att beroende på hur rättsystemet utformats utifrån grundläggande värden får det varierande effekt på den enskildes integritetsskydd. Finland har konstruerat sin rättsordning utifrån värdet integritet vilket ger den enskilde juridiskt skydd på flera nivåer i rättsordningen och med ett omfattande materiellt innehåll. Sekretessen följer handlingen genom alla myndigheter. Sverige däremot har byggt en rättsordning utifrån värdet offentlighet, där sekretessen är undantaget från huvudregeln. Det gör att det finns en ökad risk för rättsbrist om inte sekretess täcker alla situationer. En lösning på ett av det svenska systemets problem, skulle kunna vara att i sekretesslagen hänvisa till artikel 8 om privatliv i Europakonventionen om de mänskliga fri-och rättigheterna.     I Europa finns det flertal exempel på länder där den politiska makten utnyttjat sin maktposition, vilket har resulterat i ett lidande för befolkningen. Många länder och dess medborgare har varit utsatta för diktaturstyre, maktmissbruk och kränkningar av mänskliga rättigheter. En konstitution kan fungera som ett medel för att garantera medborgarna vissa fri- och rättigheter samt att begränsa den styrande makten från att kränka de värderingar som är tänkta att prägla samhället.

    Den mest grundläggande författningen i ett rättssystem utgörs av en eller flera grundläggande författningar, dessa grundlagar anger riktlinjer för vilka värderingar och normer som ska styra samhället. Grundlagen, konstitutionen eller statsförfattningen ska tillförsäkra en normgivande funktion i ett rättssystem genom att reglera bland annat bestämmelser om sin överordnade ställning. Den överordnade ställningen innebär att den genom sina stadganden ska vägleda den lagstiftande makten till att anta lagar som är förenliga med grundlagen. Konstitutionen kan också tillförsäkra alla medborgare deras rättigheter att delta i det politiska rummet, genom att föreskriva grundläggande värderingar som tillförsäkrar att minoriteters rättigheter garanteras. Ett viktigt element i konstitutionalismen är just att begränsa att en politiskt vald makt inte ska kunna ändra på grundläggande författningar som enbart syftar till att gynna majoritetsåsikter i landet. Däremot finns det inga krav på vilka värderingar som konstitutionen ska föreskriva, ett lands författning kan vara god eller ond och tillförsäkra medborgarna skilda rättigheter och binda landets lagstiftande makt på olika sätt.

    Bosnien och Hercegovina (BiH) är ett land som grundar sig på en konstitution som landet själv inte har författat. Konstitutionen är unik eftersom den är skapad av omvärlden i samband med Dayton Peace Agreement med syftet att bygga upp en stat som ska tillförsäkra fred och rättvisa. Sverige däremot är ett land som har en lång tradition av fred och ett stabilt välfungerande samhälle, ett land där den politiska makten verkar med folkets förtroende. Konstitutionen har historiskt sett inte haft en stark ställning i Sverige och behovet av att begränsa den politiska makten har inte alltid varit en prioritering.

    För att försäkra konstitutionens genomslag i ett land och att den efterlevs av den lagstiftande makten krävs det någon form av kontroller som kan tillförsäkra konstitutionens effekt. Kontrollerna kan göras i form av preventiv normkontroll som utövas innan parlamentet antagit en lag och ett system av efterhandskontroll av redan antagna lagar. Båda formerna av kontroll utövas i BiH och i Sverige. I BiH utövas den preventiva normkontrollen av The Constitutional Legal Commitee (Ustavnopravna Komisija), vilka granskar alla lagförslag och andra juridiska akter under lagstiftningsprocessen i parlamentet. I Sverige finns ett liknande organ, Lagrådet som på begäran av regeringen eller aktuellt riksdagsutskott uttalar sig om ett lagförslags grundlagsförenlighet innan lagen ska antas av riksdagen. 

    Utöver den preventiva kontrollen finns det även en möjlighet att genomföra efterhandskontroll av lagarnas grundlagsförenlighet i länderna. I BiH har författningsdomstolen ensam kompetens i att utöva den konkreta normkontrollen och har möjlighet att kräva en ändring av en lag eller att kräva upphävning av en rättsakt som bedömts vara oförenlig med den nationella konstitutionen. I Sverige utövas den konkreta normkontrollen av alla de allmänna domstolarna men också av förvaltningsmyndigheterna. Om något av dessa organ skulle förklara att en lag inte är förenlig med grundlagen kan de enbart åsidosätta den grundlagsstridiga lagen i det aktuella ärendet.9 BiH och Sverige är länder med tämligen olika konstitutioner och de har valt skilda metoder för att garantera konstitutionens genomslag. Uppsatsen kommer att belysa ländernas likheter och skillnader vid den konkreta normkontrollen samt undersöka vad för effekter dessa skilda modeller av konkret normkontroll ger för att försäkra konstitutionens värderingar och dess genomslag.

    Det övergripande syftet med denna explorativa ekonomisk historiska studie är att empiriskt kartlägga och analysera utvecklingen av konkurser och sammanhängande gäldenärsbrott i Sverige. Våra kunskaper om företagsnedläggningar är begränsade. Genom planerad användning av konkursinstitutet kan tillgångar omfördelas i icke önskvärd eller medvetet riktning och på så sätt snedvrida selektionsmekanismen. Konkursinstitutet kan användas som ett finansiellt instrument. Det finns inga tidigare studier som ger information om den totala tillgångs- och skuldsituationen i de företag som går i konkurs. Brist på kunskap, erfarenhet och kompetens hos företagsledningen uppfattas i svenska och utländska studier som de mest frekventa och betydelsefulla orsakerna till konkurs. Ett syfte är därför att skatta hur stora tillgångar som omfördelas genom konkursinstitutet. Denna studie utgår från tidigare ofta förbisedda institutionella utgångspunkter om orsaker till konkurs och konkursbrottslighet. Svensk konkursutveckling analyseras därför relativt utvecklingen i Tyskland och Österrike. Båda länder har jämförbara politiska och ekonomiska system. Även om lagverken kring obestånd och konkursbrottslighet i dessa länder liknar den svenska finns det skillnader. Det empiriska underlaget i denna studie utgörs främst av longitudinella databaser över företag på obestånd i Tyskland, Sverige och Österrike. Dessa data har kompletterats med uppgifter ur respektive lands brottsstatistik. Studiens resultat visar att beloppen som årligen omfördelas genom konkursinstitutet är betydande. Graden med vilken myndigheterna ingriper i konkursprocessen och vilka intressen man skyddar via lagen spelar roll för den totala konkursfrekvensen. Studien visar även att svenska företagare använder konkurssystemet i större utsträckning än sina kolleger i Tyskland och Österrike. Resultaten visar visserligen på ett positivt samband men antalet brottsliga konkurser ökar snabbare. Österrike som har den lägsta konkursfrekvensen uppvisar den högsta brottskvoten. Förklaringen till paradoxen finns i landets regelverk kring obestånd. Dessa resultat står i kontrast till den mikroekonomiska förklaringen att skillnader i individrelaterad kompetensbrist eller brottsbenägenhet utgör huvudförklaringen bakom olikheter i olika länders frekvens av konkurser och konkursbrott.

    The ‘open society’ has become a watchword of liberal democracy and the market system in the modern globalized world. Openness stands for individual opportunity and collective reason, as well as bottom-up empowerment and top-down transparency. It has become a cherished value, despite its vagueness and the connotation of vulnerability that surrounds it. Scandinavia has long considered itself a model of openness, citing traditions of freedom of information and inclusive policy making. This collection of essays traces the conceptual origins, development, and diverse challenges of openness in the Nordic countries and Austria. It examines some of the many paradoxes that openness encounters and the tensions it arouses when it addresses such divergent ends as democratic deliberation and market transactions, freedom of speech and sensitive information, compliant decision making and political and administrative transparency, and consensual procedures and the toleration of dissent.

    The European Convention guarantees the right to assembly. Since the ratification of the Convention Sweden has been obligated to make proportionality balances when granting or restricting the right. However, the process of how the proportionality assessments work when cancelling or dissipating a public gathering, and thereby limit the right to protest, is unmapped. Therefore, the aim of this study is to analyze the legal problems that emerges by studying the Parliamentary Ombudsman’s and the Chancellor of Justice’s proportionality assessments relating to the right to protest. This will be done by comparing nine decisions made by the Parliamentary Ombudsman and the Chancellor of Justice between 1995 and today (2017).   The study concludes that the Parliamentary Ombudsman and the Chancellor of Justice overall made proportionality assessments and thereby respected the principle of proportionality. However, some legal problems complicated the assessments. The definition of resolution, public gathering and severe disorder can differ, which can result in discretional exercise of official authority. This may, in turn, restrict the freedom of assembly and thereby be a threat to the democracy.

    In the crime policy field, the crime victim is usually described as the direct opposite of the offender in terms of characteristics and needs. This article analyses crime policy descriptions of crime victims and offenders, with a special focus on how politicians address the issue of the victim-offender overlap. The material comprises a sample of legislative crime policy bills submitted by members of the Swedish parliament during 2005-10. In the bills, crime victims are described as good, innocent and in need of help, whereas the offender is seen as a bad, ruthless scoundrel. In between stands a group of victim-offenders; pitiable poor things. However, when responses to offenders are discussed, both poor things and scoundrels are to be punished severely. © The Author(s) 2013.

    This essay discusses in a comparative way the Swedish and Norwegian legal system, mainly laws that contain adoption regulations. It also compares the administrative work that the government in both countries practices in relation to the individual person. In this essay, focus lies on the legal rights of the child in the adoption process and how well the government and its service meet the requirements from abroad.This essay has shown that the government has many rules and regulations that regulate their work and that all the sub processes are designed to ensure the child’s best in the adoption in both Sweden and Norway. Despite some differences in the investigation process, the work is very much alike. The differences in the investigation that leads to an approval has shown that the government in Norway is not as controlling in comparison to the Swedish government. This could lead to the child’s rights being neglected to a certain extent.

    Den 22 juli 2011 bombade Anders Behring Breivik regeringskvarteren i Oslo. 8 personer dog och flera skadades. Bomben orsakade också stor materiell skada. Några timmar senare sköt gärningsmannen ihjäl 69 personer på ön Utøya. Denna studie undersöker hur Dagens Nyheter, Göteborgs-Posten, Aftonbladet och Expressen rapporterade kring händelserna de fem första dagarna efter dåden. Med utgångspunkt i ett diskursperspektiv har studien genom kvalitativ analys av texterna svarat på hur gärningsmannen till de båda dåden har förklarats i de fyra tidningarna. Det har visat sig att han beskrivits på många olika sätt. Han har framställts som exempelvis terrorist och högerextrem, personlighetsstörd och som psykiskt sjuk. Dessa skapar tillsammans med andra beskrivningar, som exempelvis singel, frimurare eller ond, en bild av gärningsmannen som inte är enhetlig. Beskrivningarna fungerar som förklaringar till dåden. Det kan med stöd i tidigare forskning vara så att rädslan över att kategorisera rasistiska ytt-ringar eller som i detta fall, terroristiska och högerextrema sådana, vilket gör att gärnings-mannen inte kategoriseras som det ena eller det andra utan får flera benämningar. Studien har som en andra slutsats kommit fram till att de olika rubriceringarna fungerar som en förklar-ingsmodell eller orsak till brottet eftersom det inte förklaras djupare utan får stå för sig själva. En tredje slutsats är att terrorism och terrorist är beteckningar på brottet och gärningsmannen, snarare än en förklaring till varför det inträffat. Detta eftersom dessa beteckningar återkom-mer oavsett vilken förklaring som anges.

    This master thesis examines Directive 2014/66/EU of the European Parliament and of the Council on the conditions of entry and residence of third-country nationals in the framework of an intra-corporate transfer, the so-called ICT-directive and its corresponding rules in the Swedish legal framework with a main point on the principles of good administration. This issue is deliberated in relation to the direct effect of the European Union and the national procedural and institutional autonomy to determine whether the Directive’s procedural safeguards have been implemented satisfactorily. The principle of good administration has a wide comprehension and therefore, in this thesis, the focus is on the right to have his or her affairs handled impartially and fairly, an obligation of the administration to give reasons for its decisions and a right to be heard in the Directive and the corresponding rules of the Swedish utlänningslagen (2005:716) and utlänningsförordningen (2006:97) also with consideration to the Swedish förvaltningslagen (1986:223) and the new förvaltningslagen (2017:900). This master thesis is based on the legal-judicial and comparative law approaches to solve the legal problems that arise after the national implementation of this Directive. Finally, criticism has been directed towards the principle of good administration in the Union law and Swedish law.

    The content of this essay is about video surveillance related to personal privacy. One of the essay main objectives is to investigate and identify the current law on video surveillance through the proper dogmatic approach. There is an intention to study the interest of video surveillance in both the right to life and protection of property in relation to the right to privacy, where personal integrity is covered. The focus is on kameraövervakningslagen (2013: 460) which is applicable at places where public units have access. But at the same time the privacy aspect is very strong in terms of places where the public units don’t have access and therefore the consequences of the treatment and storage of video and audio recordings are highlighted in the essay. It is extremely important to highlight both areas to achieve a rich discussion. The public interest and privacy interest will be compared on the European and national level regarding the selected rights. The questions concerning the balance of both the public and personal interests are complicated in the Supreme Administrative Courts. With a continued purpose, the essay will highlight the problems in the new kameraövervakningslagen (2013: 460) on permitting and enforcement issues based on case law. The prevailing factors at the new camera surveillance act will be associated with the selected rights and will be evaluated in a court case analysis.
